Welcome to Advanced Sonography Screening LLC (“Advanced Sonography Screening,” the “Company,” “we,” or “us”) website at https://www.AdvancedSonographyScreening.com (including all content under the “AdvancedSonographyScreening.com” domain name, and referred to herein as the “Website”). We provide the Website and the associated services, online scheduling tools, communications, data, information, software, updates and materials (altogether, the “Materials”), subject to your agreement to and compliance with the terms and conditions set forth in this document (the “Agreement”). This Agreement governs your access to and use of the Website, communications with the Company, and Materials, and applies to all users of the Website and Services.
IMPORTANT: BY ACCESSING, BROWSING, OR USING THE WEBSITE OR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE LEGALLY BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT USE THE WEBSITE OR SERVICES.
General Provisions
This Agreement constitutes a legally binding agreement between you (“you,” “user,” or “participant”) and Advanced Sonography Screening LLC, located at 1500 Walnut St, Suite 900, Philadelphia, PA 19102. This Agreement governs your access to and use of the Website and any services provided by or through the Website or in connection with scheduling, receiving, or purchasing our screening services (collectively, the “Services”).
The Website and Services are offered only to users who are 18 years of age or older. By using the Website or Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract. If you do not meet these requirements, you must not access or use the Website or Services.
You agree to comply with this Agreement, all applicable laws and regulations, and all policies, practices, and notices that we provide or reference in connection with the Website or Services.
Medical and Informational Disclaimer; No Emergency Use
Disclaimer: The information provided on this website and through Advanced Sonography Screening LLC. services is for general preventive health and for cardiovascular disease risk assessment only. Our cardiovascular screenings are not a medical diagnosis and do not replace consultation, diagnosis, or treatment by a licensed healthcare professional. Results from screenings are intended to provide guidance on your risk and should be discussed with your physician. Advanced Sonography Screening LLC., its employees, and affiliates are not responsible for any medical decisions or actions taken based on the information or results provided. By using our website or services, you acknowledge and agree to these terms.
This website may feature logos, trademarks, or references belonging to other companies (“Third-Party Trademarks”). Such use is for informational and reference purposes only and does not imply any affiliation, sponsorship, or endorsement by those third parties. All Third-Party Trademarks are the property of their respective owners. For example, “QuantaFlo® PAD” is a registered trademark and is used here with permission. The Website and Services are not intended for, and must not be used for, emergency medical needs. If you believe you are experiencing a medical emergency (including symptoms consistent with heart attack or stroke), seek immediate emergency medical assistance by calling 911.
Screening Services; Limitations; No Diagnosis
You understand and acknowledge that our Services consist of preventive screening tests and related informational reporting. Screenings are not medical diagnosis and do not replace evaluation, diagnosis, or treatment by a licensed healthcare professional. Screening results should be reviewed with your physician or other qualified provider.
No screening test can screen for every possible cause of cardiovascular events. It is possible to receive normal screening results and still experience a heart attack, stroke, or other serious event. Certain conditions may not be assessed by the Services, and screening does not constitute comprehensive cardiovascular evaluation.
You acknowledge and agree that:
- screening results are limited to the scope of the test performed;
- screening results may include false positives or false negatives; and
- clinical correlation by a licensed healthcare professional is necessary.
Changes to the Website and Services
We reserve the right to change, modify, supplement, discontinue, suspend, or otherwise alter the Website, Materials, Services, pricing, offerings, or any aspect or feature of the foregoing at any time, with or without notice. Changes are effective upon posting on the Website or otherwise being communicated. Your continued use constitutes acceptance of such changes.
Insurance; Medicare; Claims
Advanced Sonography Screening LLC. does not participate in Medicare and does not submit insurance claims. Fees for Services are the responsibility of the purchaser. If we state that a service “may be eligible” for reimbursement (including HSA/FSA), such statements are informational only and do not constitute a guarantee of coverage or reimbursement. You are responsible for confirming eligibility with your plan administrator and complying with any applicable requirements.
Cancellation and Rescheduling Policy
If you are unable to attend a scheduled appointment, the following cancellation and rescheduling policy applies unless otherwise stated at the time of booking or in your confirmation materials:
- Cancellations or rescheduling made more than forty-eight (48) hours prior to the scheduled appointment: A full refund will be issued in the form of a service credit, which may be used by the individual who purchased the screening and may be transferable to another individual for future screening services, subject to operational requirements.
- Cancellations or rescheduling made within forty-eight (48) hours of the scheduled appointment: A $50 cancellation fee will be assessed, and the remaining balance (if any) will be issued as a service credit for future screening services.
Communications (Mail, Email, Phone Calls, and Text Messages)
By using the Website or Services, purchasing Services, or creating an account and by providing your contact information, you consent to receive communications related to your appointments, scheduling, service updates, instructions, results availability, billing, and other administrative matters. You may also be presented with options to receive marketing communications. Obtaining Services is not contingent upon consenting to marketing communications.
Certain communications may be delivered via automated systems, including prerecorded emails, voice messages or SMS text messages, as permitted by law.
Marketing opt-out. You may opt out of marketing emails through the unsubscribe mechanism included in the email, and you may opt out of certain marketing calls/texts by following the instructions provided in the communication or by contacting us. Even if you opt out of marketing, we may still send service-related communications (e.g., appointment confirmations, reminders, operational instructions, and results notifications).
SMS terms. If you enroll in or provide consent for SMS communications:
- message frequency varies;
- message and data rates may apply;
- carriers are not liable for delayed or undelivered messages; and
- you may opt out by replying “STOP” (or other keyword indicated in the message).
If you experience issues with our messaging program, you may reply “HELP” (if available) or contact us using the information in the Contact Information section below.
We reserve the right to restrict or block communications to protect our systems, maintain operational integrity, or address suspected misuse, fraud, or violations of this Agreement.
Intellectual Property; Permitted Use
The Website, Materials, and Services (including their design, “look and feel,” text, graphics, logos, images, audio, video, software, and other content) are owned by or licensed to Advanced Sonography Screening and are protected by applicable intellectual property laws. All rights not expressly granted are reserved.
Subject to your compliance with this Agreement, we grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Website and Materials for your personal, non-commercial use.
You agree not to copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, reverse engineer, decompile, or disassemble any portion of the Website or Materials except as expressly permitted by this Agreement or by applicable law.
Third-Party Content and Linked Websites
The Website may include third-party content or links to third-party websites, applications, tools, or services. Such content and links are provided solely as a convenience. We do not control third-party resources and do not endorse, sponsor, or assume responsibility for third-party content, products, services, or practices.
You acknowledge and agree that we are not responsible or liable for third-party content or third-party websites, including any claims that third-party content infringes intellectual property rights or is inaccurate, incomplete, or harmful. You are encouraged to review the terms and policies of any third-party website or application you visit.
Registration, Accounts, and Passwords
The Website may permit or require registration or account creation to access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account. You agree to notify us promptly of any unauthorized use or suspected breach of security. You acknowledge that you may be responsible for losses or harm resulting from failure to protect your account credentials.
Restrictions on Use
You agree that you will not:
- violate any law or regulation in connection with your use of the Website or Materials;
- interfere with or disrupt the operation, security, or functionality of the Website;
- transmit or introduce harmful code (including viruses, worms, trojans, or similar);
- attempt to probe, scan, or test the vulnerability of the Website or breach security measures;
- scrape or harvest content or data via automated means;
- submit false, incomplete, or misleading information; or
- impersonate another person or entity.
We reserve the right, in our sole discretion, to suspend or terminate access to the Website or Services for violations or suspected violations of this Agreement.
Disclaimer of Warranties
The Website, Materials, and Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.
We do not warrant that the Website or Services will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components, or that any defects will be corrected.
Some jurisdictions do not allow certain warranty exclusions; if applicable law prohibits a particular exclusion, that exclusion shall apply only to the maximum extent permitted.
Limitation of Liability
To the maximum extent permitted by law, in no event shall Advanced Sonography Screening LLC. or its members, managers, officers, employees, contractors, affiliates, licensors, vendors, service providers, or business partners (collectively, “Related Parties”) be liable for any indirect, incidental, consequential, punitive, exemplary, or special damages, including loss of data, arising out of or related to your use of, or inability to use, the Website, Materials, or Services, regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise), even if advised of the possibility of such damages.
Where liability cannot be excluded, it shall be limited to the maximum extent permitted by law. You acknowledge that these limitations are fundamental elements of the Agreement and that the Website and Services would not be provided absent such limitations.
Indemnification
You agree to defend, indemnify, and hold harmless the Company and its Related Parties from and against any claims, actions, proceedings, damages, obligations, losses, liabilities, costs, expenses, or fees (including reasonable attorneys’ fees) arising from (i) your use of and access to the Website, Materials, or Services; (ii) your violation of this Agreement; (iii) your violation of any third-party rights; or (iv) unlawful conduct facilitated through your use of the Website or Services. This obligation survives termination.
Disputes; Arbitration; Class Action Waiver
ARBITRATION CLAUSE AND CLASS ACTION WAIVER – IMPORTANT – PLEASE REVIEW AS THIS AFFECTS YOUR LEGAL RIGHTS.
You agree that any claim or dispute arising out of or relating to this Agreement, the Website, Materials, or Services will be resolved by binding arbitration rather than in court, except that you may assert claims in small-claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law govern this arbitration provision.
Arbitration will be administered by the American Arbitration Association (“AAA”) under its rules then in effect. There is no judge or jury in arbitration, and court review of an arbitration award is limited; however, an arbitrator may award relief available in court on an individual basis and must follow the terms of this Agreement.
To begin arbitration, you must send a written notice of your claim and request for arbitration to the Notice address listed below.
No class action. You and we agree that disputes will be conducted only on an individual basis and not in a class, consolidated, representative, or private attorney general action. You are giving up your right to participate as a class representative or class member. If the class action waiver is found unenforceable, the arbitration provision may be deemed unenforceable to the extent required by law.
Notwithstanding the foregoing, we may seek injunctive or equitable relief in court to prevent infringement or misuse of intellectual property or other proprietary rights.
Any dispute or claim must be brought within one (1) year after the events giving rise to the claim, to the extent permitted by law.
Applicable Law; Jurisdiction
This Agreement shall be construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except as superseded by the Federal Arbitration Act with respect to arbitration. The Website may be accessed from locations outside Pennsylvania and outside the United States; you are responsible for compliance with local laws where you access the Website.
Severability
If any provision of this Agreement is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. Any provision held unenforceable only in part shall remain in effect to the extent enforceable. The parties agree to replace any invalid or unenforceable provision with a valid provision that most closely reflects the original intent.
Privacy Notices
We maintain separate privacy notices that describe how we collect, use, and protect personal information. Those notices are provided separately and are not incorporated here unless expressly stated.
